Welcome to Gigi, the AI wingwoman app brought to you by Time 3.0 Inc.(“Company,” “we,” or “us”). These Terms of Use (“Terms”) govern your access to and use of the Gigi app, website, and services (collectively, the “Service”). By accessing or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

ELIGIBILITY

You must be at least 18 years old to use Gigi. By using the Service, you confirm that you meet this age requirement. The Service is not available to users previously banned by the Company.

DATA USAGE AND PERMISSIONS

By using Gigi, you grant the Company permission to collect, use, and analyze publicly available data about you to improve our matchmaking and compatibility features. Publicly available data includes everything that exists publicly on the internet, such as information accessible on social media platforms or other public domains. We may collect and analyze additional data from third-party sources (e.g., social media integrations) to enhance the user experience and improve services.

USER RESPONSIBILITIES

You agree not to attempt to alter, manipulate, or interfere with the behavior of Gigi’s AI systems in any way, including sending prompts or messages designed to change the app’s responses. You are responsible for keeping your account information secure and accurate.

COMMUNITY STANDARDS AND PROHIBITED CONDUCT

Abusive, offensive, or illegal behavior is strictly prohibited. Violations include but are not limited to: harassment, hate speech, or discriminatory remarks; sharing obscene or profane content; posting false or misleading information. The Company reserves the right to terminate accounts for any behavior that threatens the integrity of the community.

ACCOUNT TERMINATION

The Company reserves the right to suspend or delete accounts without prior notice for any breach of these Terms, including but not limited to attempts to manipulate the AI, abusive behavior, or violations of applicable laws. If you are banned from the Service, you may not create a new account without prior written approval from the Company.

MODIFICATIONS TO THE SERVICE

The Company may modify or discontinue the Service, or any portion thereof, at any time without prior notice.

LIMITATION OF LIABILITY

The Service is provided on an “AS IS” basis. The Company makes no guarantees regarding the accuracy, availability, or reliability of the Service and is not liable for any damages arising from your use of the Service.

GOVERNING LAW

These Terms are governed by the laws of the State of New York, USA. Any disputes will be resolved through binding arbitration in New York County.

CHILD SAFETY STANDARDS POLICY

Prohibition of Child Sexual Abuse and Exploitation (CSAE):

By using Gigi, you agree to adhere to our strict prohibition of any content or behavior related to Child Sexual Abuse and Exploitation (CSAE). Users engaging in such activities will face immediate account termination and be reported to the appropriate authorities. This prohibition extends to all user-generated content, including but not limited to profiles, messages, images, and other forms of communication within the platform.


Reporting Mechanism:

Gigi provides an in-app reporting mechanism for users to flag inappropriate or concerning content, including any material that may involve CSAE. Users can report content by selecting the "Report" option available on profiles, chat messages, or other interactive features within the app. Reports are reviewed by our moderation team, and appropriate action is taken in a timely manner.


Addressing Child Sexual Abuse Material (CSAM):

If Gigi becomes aware of any Child Sexual Abuse Material (CSAM) on the platform, we will:

  1. Immediately remove or disable access to the material.

  2. Report the incident to the National Center for Missing and Exploited Children (NCMEC) or relevant authorities in compliance with applicable laws.

  3. Fully cooperate with law enforcement to support investigations and prosecutions.

By agreeing to these Terms, you consent to these actions if your content or behavior is found to violate our CSAE policies.


Child Safety Compliance:

As part of our commitment to maintaining a safe community, Gigi complies with all child safety laws and regulations. This includes but is not limited to cooperating with regional authorities and law enforcement agencies in the event of reported incidents involving CSAE or CSAM.


User Responsibility:

All users are responsible for ensuring their content and behavior comply with Gigi’s Terms of Use, including the prohibition of CSAE. Violations of these terms may result in:

  1. Account suspension or termination.

  2. Permanent banning from the platform.

  3. Reporting to law enforcement and other relevant authorities.


Designated Child Safety Contact:

Gigi has a designated Child Safety Officer to address issues related to CSAE and act as a point of contact for Google Play notifications or law enforcement requests.
